Terms & Conditions

for the submission of a Proposed Name and/or Logo for the KZN Touch Association, (KZNTA)

 

The promoter is the KZN Touch Association, (KZNTA) , (“the Promoter”)

 

1) Eligibility

  1. Proposals of name(s) and/or logo(s) are open to South African residents only.
  2. Entrants must be over 18 years of age. Entrants expressly declare that they are duly authorised to participate.

2) Acceptance

  1. By submitting a proposal, all participants agree to be bound by these rules, which will be interpreted by the Promoter, in its sole discretion and its decision regarding any dispute will be conclusive, final and binding and will not be challenged on any grounds, including without limitation, the grounds that the Promoter failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles or procedural fairness.
  2. KZNTA reserves the right to amend the validity dates at any time.
  3. To enter a proposal all entrants must comply by submitting the details as requested. Entries will be considered incomplete and thus disqualified if the entrant does not provide all requested information.

3) Entries

  1. To enter a proposal, all ideas, concepts and material must be original, submitted by the entrant with the legal right to use such material.
  2. Entries will not be accepted unless submitted via the official channel.
  3. A person may enter multiple times.
  4. By entering, the entrant agrees to be bound by the rules specified in these terms and conditions.
  5. Entries will be open from 17 July 2023 to 21 July 2023. Any entries received after the closing date will be invalid.
  6. The decision of the Promoter is final and the Promoter shall not enter into any correspondence about the result.
  7. The promoter reserves the right not to use any proposals submitted, and to seek proposals from other sources as deemed necessary.
  8. Entries that do not comply with these terms and conditions will be disqualified.
  9. The Promoter shall not be liable for any disruption to the submission process, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of any disruption to the submission process the Promoter shall use its reasonable endeavours to remedy any disruption and resume the submission process on a fair and equitable basis to the entrants.
  10. By submitting a proposal entrants warrant that all information submitted by them is true, current, and complete.

5) Personal Data

  1. Submission of a proposed name and/or logo, and personal information as specified in the submission entry form is required for entry. All of the data submitted by you is collected, processed and used by KZNTA in order to administer the proposals in terms of the POPIA.
  2. The Promoter keeps the data to fulfil the purposes for which it was collected or as required by applicable laws or regulations.

6) Ownership and Publicity

  1. KZNTA reserves the right to publish names of entrants and the proposed name(s) and/or logo(s) of entrants.
  2. By submitting a proposal, entrants agree that the proposed name(s) and/or logo(s) submitted by them can be used by KZNTA for any and all purposes and that their submission may be published and used, in part or in full by KZNTA, and may be adapted and amended by KZNTA for their own purposes. All copyright and proprietary rights are relinquished by the entrant, giving full rights to KZNTA.
  3. Details of proposals may also be announced on the Promoter’s website and any other media properties that it chooses.

7) Release of Liability

  1. The Promoter reserves the right to terminate the submission process at any time.
  2. The Promoter cannot accept any responsibility for entries not received because they have been lost, or not received due to interrupted internet connections or miscommunications, or other electronic malfunctions.
  3. Any entries found to be fraudulent will result in the entrant being excluded.
  4. By participating, all entrants release the Promoter, its affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this submission process from any and all liability with respect to and in any way arising from participation in this submission process.
  5. The Promoter reserves the right to modify or cancel the submission process in the event that any portion of any website used to administer any aspect of the submission process becomes technically corrupted.
  6. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.

8) Privacy Policy

  1. KZNTA (“the Promoter”) treats all information collected as confidential and will not sell, share or rent this information to any other third-parties.
  2. Information is collected by specifically requesting it from you, this occurs when you submit a proposal.
  3. KZNTA reserves the right to change the terms and conditions at any given time.
